ON DIRECT TO CONSUMER SHIPMENT OF ALCOHOL INTO TENNESSEE

A consumer can go online and order a bottle of Jack Daniel’s from a wide selection of online retailers, but that doesn’t make it lawful here in Tennessee.  Direct to consumer shipping of spirits is prohibited in Tennessee.  Below see a letter from earlier this year from then Tennessee Alcoholic Beverage Commission director, Clay Byrd, which clearly states that there is currently no legal means for out of state shipping of spirits to a Tennessee consumer.  There are many anticipated changes to our country’s alcoholic beverage laws after the recent United States Supreme Court decision of TWSRA v. Thomas.  Will we see an expansion of direct shipping, currently limited to wine, into other types of booze?  We are closely following court decisions in this area and will cover here any noteworthy changes.
